Abstract

The development of Islamic financial technology requires ḥadīth norms originating in pre-digital contexts to be applied to increasingly complex transactions. This study examines the patterns, methodological transparency, and juridical adequacy of ḥadīth-based reasoning in DSN-MUI Fatwas Nos. 116/2017, 117/2018, and 140/2021. Employing a qualitative socio-legal approach, the study combines content analysis of fatwas with semi-structured interviews with DSN-MUI members, Sharia Supervisory Board members, and Islamic fintech practitioners. The findings reveal that ḥadīth mobilization is principle-based, contract-sensitive, and functionally layered, operating as prohibitive evidence, contractual legitimation, and ethical-regulatory reinforcement. Prohibitive reasoning is more readily traceable than the interpretive processes that make novel digital transactions permissible. This compression of legal reasoning is conceptualized as normative telescoping. At the same time, epistemic traceability measures how well one can reconstruct the relationship between ḥadīth and digital rulings. The study recommends a methodological appendix documenting the relevant evidence, takyīf fiqhī, operative ʿillah, method of legal extension, maqāṣid, and implementation responsibilities to enhance the transparency and adaptability of Islamic fintech fatwas.
